Unfortunately, this area of the law is and evolving and somewhat controversial one. The main thing is the legitimacy of the questions based on the potential employer's needs. The law allows for a fairly broad background check, which includes access to a person's public records, but in California employers are not allowed to withhold hiring someone based on a prior arrest.
